2. Geltungsbereich
2.1 Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle
Verträge zwischen dem Verkäufer und seinen Kunden
über den Online-Shop Retro23.
2.2 Verbraucher ist jede natürliche Person, die ein Rechtsgeschäft zu
privaten Zwecken abschließt.
Unternehmer ist jede natürliche oder juristische Person in Ausübung ihrer
gewerblichen Tätigkeit.
3. Vertragsschluss
3.1 Die im Online-Shop dargestellten Produkte stellen kein rechtlich
bindendes Angebot dar, sondern eine Aufforderung zur Abgabe einer
Bestellung.
3.2 Mit Abschluss des Bestellvorgangs gibt der Kunde ein verbindliches
Kaufangebot ab.
3.3 Der Vertrag kommt zustande durch
• Versandbestätigung oder
• Lieferung der Ware oder
• erfolgreiche Zahlungsabwicklung bei unmittelbaren Zahlungsarten
(z. B. PayPal, Klarna)
3.4 Die Bestellabwicklung erfolgt in der Regel per E-Mail.
4. Preise und Zahlungsbedingungen
4.1 Alle Preise sind in Euro angegeben und enthalten die gesetzliche
Mehrwertsteuer.
4.2 Versandkosten werden im Bestellprozess gesondert ausgewiesen.
4.3 Die Zahlung erfolgt über die im Online-Shop angebotenen
Zahlungsarten (z. B. Kreditkarte, PayPal, Klarna, Shopify Payments).
4.4 Die Belastung erfolgt unmittelbar nach Abschluss der Bestellung.
5. Produktion, Lieferung und Versand
5.1 Die angebotenen Produkte werden individuell auf Bestellung produziert
(Print-on-Demand).
5.2 Produktion und Versand erfolgen über den externen Partner:
WhiteWall GmbH
5.3 Die Lieferzeiten sind produktabhängig und im Online-Shop angegeben.
5.4 Teillieferungen sind zulässig, soweit dies für den Kunden zumutbar ist.
5.5 Sollte ein Produkt nicht verfügbar sein, wird der Kunde unverzüglich
informiert und bereits geleistete Zahlungen werden erstattet.
6. Eigentumsvorbehalt
Die Ware bleibt bis zur vollständigen Bezahlung Eigentum des Verkäufers.
7. Widerrufsrecht
7.1 Verbrauchern steht grundsätzlich ein gesetzliches Widerrufsrecht zu.
7.2 Ausschluss des Widerrufsrechts
Das Widerrufsrecht besteht nicht bei Verträgen zur Lieferung von Waren,
• die nicht vorgefertigt sind und für deren Herstellung eine
individuelle Auswahl oder Bestimmung
durch den Kunden maßgeblich ist
• oder die eindeutig auf die persönlichen
Bedürfnisse zugeschnitten sind
(§ 312g Abs. 2 Nr. 1 BGB)
7.3 Weitere Informationen sind in der separaten Widerrufsbelehrung
enthalten.
8. Mängelhaftung (Gewährleistung)
Es gelten die gesetzlichen Gewährleistungsrechte.
9. Haftung
9.1 Der Verkäufer haftet uneingeschränkt bei
• Vorsatz und grober Fahrlässigkeit
• Verletzung von Leben, Körper oder Gesundheit
9.2 Bei leichter Fahrlässigkeit haftet der Verkäufer nur bei Verletzung
wesentlicher Vertragspflichten (Kardinalpflichten) und beschränkt auf den
vorhersehbaren Schaden.
10. Urheberrecht
10.1 Alle angebotenen Werke (Kunst, Designs etc.) sind urheberrechtlich
geschützt.
10.2 Mit dem Kauf wird ausschließlich ein Nutzungsrecht für den privaten
Gebrauch übertragen.
10.3 Jede darüber hinausgehende Nutzung, insbesondere Vervielfältigung
oder kommerzielle Nutzung, ist ohne ausdrückliche Zustimmung
unzulässig.
11. Anwendbares Recht
Es gilt deutsches Recht unter Ausschluss des UN-Kaufrechts.
Bei Verbrauchern gilt dies nur, soweit keine zwingenden
Verbraucherschutzvorschriften entgegenstehen.
12. Gerichtsstand
Für Kaufleute, juristische Personen des öffentlichen Rechts oder öffentlichrechtliche
Sondervermögen ist der Gerichtsstand der Sitz des Verkäufers.
13. Alternative Streitbeilegung
Die EU-Kommission stellt eine Plattform zur Online-Streitbeilegung bereit:

Der Verkäufer ist nicht verpflichtet und nicht bereit, an einem
Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle
teilzunehmen.

2. Scope of Application
2.1 These Terms and Conditions apply to all contracts concluded between the Seller and the Customer via the online shop Retro23.
2.2 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. An entrepreneur is a natural or legal person acting in the exercise of their commercial or independent professional activity.
3. Conclusion of the Contract
3.1 The product descriptions in the online shop do not constitute legally binding offers on the part of the Seller, but rather serve the purpose of submitting a binding offer by the Customer.
3.2 The Customer submits a binding offer to purchase by completing the order process.
3.3 The contract is concluded by:
- An order confirmation via e-mail, or
- The delivery of the goods, or
- Successful payment processing when using direct payment methods (e.g., PayPal, Klarna).
3.4 Order processing and contact usually take place via e-mail.
4. Prices and Payment Terms
4.1 All prices stated are in Euros and include the statutory value-added tax (VAT).
4.2 Shipping costs are indicated separately during the order process.
4.3 Payment can be made using the payment methods offered in the online shop (e.g., Credit Card, PayPal, Klarna, Shopify Payments).
4.4 The account will be charged immediately upon completion of the order.
5. Production, Delivery, and Shipping
5.1 The products offered are manufactured individually upon order (Print-on-Demand).
5.2 Production and shipping are carried out via the external partner: WhiteWall GmbH.
5.3 Delivery times depend on the product and are stated in the online shop.
5.4 Partial deliveries are permissible, provided this is reasonable for the Customer.
5.5 If a product is unavailable, the Customer will be informed immediately, and any payments already made will be refunded.
6. Retention of Title
The Seller retains title to the delivered goods until the purchase price has been paid in full.
7. Right of Withdrawal (Right of Cancellation)
7.1 Consumers are generally entitled to a statutory right of withdrawal.
7.2 Exclusion of the right of withdrawal:
The right of withdrawal does not apply to contracts for the supply of goods:
- that are not prefabricated and for the manufacture of which an individual choice or decision by the consumer is decisive,
- or which are clearly tailored to the personal needs of the consumer (§ 312g Abs. 2 Nr. 1 BGB).

8. Liability for Defects (Warranty)
Statutory warranty rights apply.
9. Liability
9.1 The Seller holds unlimited liability for:
- Intent and gross negligence.
- Injury to life, body, or health.
9.2 In cases of slight negligence, the Seller is only liable for the breach of essential contractual obligations (cardinal obligations), and liability is limited to the foreseeable, typical damage.
10. Copyright
10.1 All offered works (art, designs, etc.) are protected by copyright.
10.2 With the purchase, only a right of use for private, personal purposes is transferred.
10.3 Any further use, in particular reproduction, distribution, or commercial use, is strictly prohibited without the explicit prior consent of the artist.
11. Applicable Law
German law applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law only applies to the extent that the granted protection is not withdrawn by mandatory provisions of the law of the country in which the consumer has their habitual residence.
12. Place of Jurisdiction
If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction shall be the registered office of the Seller.
13. Alternative Dispute Resolution
The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr
The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
